These Terms of Service ("Terms") govern your access to and use of WaterOperatorPracticeTest.com (the "Site"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. The Site is an independent study aid

Important: WaterOperatorPracticeTest.com is an independent study aid. It is not an official preparation resource for any state or national certification program. We are not affiliated with, sponsored by, or endorsed by the United States Environmental Protection Agency (EPA), the American Water Works Association (AWWA), the Association of Boards of Certification (ABC), or any state primacy or licensing agency.

2. No warranty of accuracy

We make a reasonable effort to ensure that practice questions and explanations are technically accurate, but we make no warranties or representations regarding the accuracy, completeness, or currency of any content on the Site. Practice content is provided "as-is" for study purposes only. The actual content, format, and scoring of state and national water operator certification exams varies by jurisdiction and changes over time. You are responsible for confirming current requirements with your state's certification program.

3. Not professional advice

Content on the Site is intended to support your studying. It is not a substitute for formal training, an accredited course of study, on-the-job experience, or the official examination resources published by your state agency. Successfully passing practice tests on this Site does not guarantee that you will pass an actual certification examination.

4. Your account

You may use the Site as a guest. If you create an account, you agree to:

Keep your password secret. You are responsible for activity that occurs under your account.
Notify us promptly of any unauthorized use of your account.
Not create more than one account for yourself.

The Site, including the practice questions, explanations, layout, code, branding, and logos, is owned by WaterOperatorPracticeTest.com and is protected by copyright, trademark, and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal study. All other rights are reserved.

7. User-submitted content

If you submit feedback, suggestions, or proposed corrections to us, you grant us a non-exclusive, perpetual, royalty-free license to use that feedback to improve the Site, without obligation to credit or compensate you.

8. Third-party services and links

The Site uses third-party services (notably Firebase by Google) to provide login and database functionality. The Site may from time to time link to third-party products or services. We are not responsible for the content, policies, or practices of any third party.

9. Disclaimer of warranties

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WATEROPERATORPRACTICETEST.COM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE — INCLUDING ANY DAMAGES ARISING FROM YOUR FAILURE TO PASS A CERTIFICATION EXAMINATION. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

11. Indemnification

You agree to indemnify and hold harmless WaterOperatorPracticeTest.com and its operators from any claim arising out of your breach of these Terms or your misuse of the Site.

12. Changes to the Site and these Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also revise these Terms by posting an updated version on this page. These Terms are governed by the laws of the United States and the State in which the operator of the Site resides, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located there.
